Terms of Service

These Terms are issued by EventPass Ticketing Limited, a company registered in Jamaica. "EventPass" refers to the ticketing platform operated by EventPass Ticketing Limited.
1. Acceptance of Terms
By accessing and using EventPass, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.
2. Event Tickets
All ticket sales are final unless otherwise stated by the event promoter. EventPass facilitates ticket purchases but is not responsible for event cancellations or changes.
Each ticket is issued a unique QR code and 6-digit ticket code for validation at the door. Tickets are non-transferable for resale above face value. You may transfer a ticket to another person using the in-app Transfer feature — the ticket is reissued with a fresh QR code and the original code is immediately invalidated. The original purchaser's identity is retained for audit purposes.
Multi-day passes grant entry to every day of a multi-day event. Each day within the pass has its own QR code for day-by-day check-in. Multi-day passes must be purchased before the event begins.
Some promoters may also sell tickets directly at the event gate for cash or card ("gate sales"). Gate tickets are issued with the same unique QR code and 6-digit code as online tickets and scan at the door identically. Because the payment is collected by the promoter in person (cash or card at the door), gate tickets are refunded by the promoter in person and cannot be refunded through EventPass — see our Refund Policy for details.
Some events sell tickets tied to a specific seat rather than general admission ("reserved seating"). Where an event uses reserved seating, you select your seat from an interactive seat map, and your chosen seat is held temporarily while you complete checkout; if checkout is not completed within the hold window, the seat is released back to general availability and may be selected by another buyer. Individual seats or sections may be priced differently from a ticket tier's advertised base price, and any such price is shown to you before you confirm your purchase. Once payment is completed, your ticket is tied to that specific seat.
2.1 Live Streaming
Some promoters choose to stream their event live via an embedded YouTube or Facebook player on the event's details page. A live stream is a feature the promoter switches on and off themselves and is visible to anyone viewing the event page — it is not restricted to ticket holders, and purchasing a ticket is neither required to view a stream nor guaranteed by the existence of one. EventPass is not responsible for the availability, quality, content, or continuity of a promoter's live stream, or for the practices of the third-party platform (YouTube or Facebook) hosting it. Promoters remain solely responsible for the legality and appropriateness of anything they stream, in the same way they are responsible for other event content under Section 9.
3. Promoter Responsibilities
Event promoters are responsible for accurate event information, ticket delivery, and event execution. EventPass reserves the right to remove events that violate our policies.
Promoters are additionally bound by our Promoter Agreement, which sets out the specific terms governing the listing of events, the payment of listing and promotional fees, payouts, verification, and the use of promoter tools. By listing an event on EventPass, promoters accept and agree to the Promoter Agreement in addition to these Terms.
4. Payment and Fees
Service fees are applied to all online ticket purchases and are paid by the ticket buyer at checkout. All payments are processed securely through our payment gateway (Fygaro). EventPass charges promoters no commission on online ticket sales and no payout or withdrawal fee — promoters receive 100% of their online ticket revenue (less any refunded amounts). A separate percentage-based gate sales fee applies to in-person cash/card sales made at the door; the buyer pays the full ticket price directly to the promoter, and the gate fee (plus any tax on it) is deducted from that specific event's own online sales payout balance. Refunds are at the discretion of event promoters and subject to our Refund Policy. Promoters may choose to disable refunds for an individual event using the "Allow refunds" toggle; where disabled, customers cannot request refunds for that event through the platform unless the event is cancelled or a lawful exception applies. Every event details page displays a Refund Policy section indicating the refund status — "Refunds available" when enabled and "No refunds for this event" when disabled — so buyers are informed before purchase. Listing fees, carousel banner fees, and promo video fees are charged to promoters and are non-refundable unless the event is rejected during admin review.
Tax (GCT) is applied to service fees and promoter add-on fees as required by law. Tax collected on fees is non-refundable.
5. Prohibited Conduct
Users may not engage in fraudulent activities, resell tickets above face value without authorization, or use the platform for unlawful purposes.
The sale of tickets for gambling, raffles, or adult entertainment events is strictly prohibited on EventPass. Promoters found listing such events will have them removed immediately and may have their accounts suspended or terminated.
Promotion of unlisted events prohibited. Using EventPass — including community posts, comments, replies, reviews, event descriptions, promoter profiles, or any other user-generated content — to promote, advertise, or direct users to events, ticket sales, or registration pages that are not listed on EventPass is strictly prohibited. This includes referencing or linking to third-party ticketing platforms, external event pages, or off-platform sales channels for events that should be listed on EventPass.
No external links. Users may not post links to websites outside of EventPass in any user-generated content, including community posts, comments, replies, reviews, or event descriptions. This includes links to external ticketing sites, social media pages, personal websites, online stores, or any other third-party web addresses. Links to other pages within EventPass are permitted. EventPass reserves the right to remove content containing external links without notice.
6. Account Security
You are responsible for maintaining the confidentiality of your login credentials. EventPass offers optional two-factor authentication (2FA) — we strongly recommend enabling it in Settings to protect your account. You are responsible for all activity under your account and must notify us immediately of any unauthorized access.
7. Limitation of Liability
EventPass is not liable for event cancellations, venue changes, or issues arising from events. Our liability is limited to the amount paid for tickets.
8. Intellectual Property
The EventPass name, logo, branding, website design, and all platform content are the intellectual property of EventPass Ticketing Limited and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any EventPass-owned content without prior written consent.
Event promoters retain ownership of the content they submit (event titles, descriptions, images, videos, and audio clips). By submitting content to EventPass, you grant EventPass a non-exclusive, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform and the listed event.
9. User-Generated Content
Promoters are solely responsible for the accuracy, completeness, and lawfulness of all event information they submit, including event titles, descriptions, dates, venues, pricing, images, videos, and audio clips. EventPass does not verify every detail of promoter-submitted content and is not liable for misrepresentation, inaccurate event information, or misleading promotional materials.
You agree not to submit content that is defamatory, infringing, fraudulent, obscene, or otherwise unlawful. EventPass reserves the right to remove or reject any content that violates these Terms or applicable law, without prior notice.
9.1 Community Feature
EventPass offers a Community feature that allows users to create posts, share photos, videos, and GIFs, create polls, leave event reviews, ask questions, quote and reply to other users' posts, and react with likes and emoji reactions. By using the Community feature, you agree to the following:
- Your content is public. Posts, reviews, replies, media, GIFs, and poll questions and options you share in the Community are visible to other users. A poll's vote counts and results are visible to anyone who can see the poll; if you vote, EventPass records your choice, but your individual vote is not shown to other users next to your name. Do not share personal or sensitive information you do not want others to see.
- Quoting other posts. When you quote another user's post or reply in your own, an excerpt of the quoted content is displayed alongside yours and links back to the original. Deleting your original post does not remove the excerpt from replies that already quoted it.
- Be respectful. You agree not to post content that is harassing, hateful, defamatory, threatening, sexually explicit, or otherwise offensive or unlawful. Personal attacks, spam, and promotional content unrelated to events are not permitted.
- No promotion of unlisted events. You may not use the Community to promote or advertise events that are not listed on EventPass, including by referencing external ticketing platforms or off-platform event registration pages.
- No external links. You may not post links to any websites outside of EventPass in your posts, replies, reviews, or any other community content. Links to pages within EventPass are permitted; all other external links will be removed.
- You own your content. You retain ownership of content you post. By posting, you grant EventPass a non-exclusive, royalty-free license to display and distribute that content within the Community feature.
- Reviews must be genuine. Event reviews should reflect your honest experience. Writing fake, paid, or misleading reviews is prohibited. Verified attendee badges are applied automatically based on ticket purchase records.
- Reporting and moderation. Users can report posts or replies that violate these Terms. EventPass reserves the right to review, remove, or hide any community content at its discretion, with or without notice.
- Accountability. You are solely responsible for the content you post and any consequences arising from it. EventPass is not liable for user-generated community content.
Promoters may reply to questions and reviews on their own events. Promoter replies are marked with a Promoter badge. Misuse of the Community feature, including impersonation or abuse of the reporting system, may result in content removal or account suspension under Section 11.
10. Third-Party Services
EventPass integrates with and relies on third-party services to deliver platform functionality, including:
- Fygaro — payment processing for ticket purchases and promoter fees.
- Google Maps — venue location display and address autocomplete.
- Firebase Cloud Messaging — push notification delivery.
- YouTube & Facebook — embedded video players used to display a promoter's live stream on the event page.
- Facebook & Instagram — optional social media campaign posting.
EventPass is not responsible for the availability, performance, or data practices of these third-party services. Your use of these services may be subject to their own terms and privacy policies. EventPass disclaims liability for any disruptions, data handling, or issues arising from third-party service providers.
11. Account Suspension and Termination
EventPass reserves the right to suspend or terminate any account at any time, with or without cause, including but not limited to:
- Engaging in fraudulent activity, chargeback abuse, or payment manipulation.
- Listing prohibited event types (gambling, raffles, adult entertainment).
- Reselling tickets above face value outside the platform's transfer feature.
- Submitting false, misleading, or unlawful event content.
- Harassing other users or misusing the support system.
- Promoting events not listed on EventPass, or posting external links to websites outside of EventPass.
- Violating applicable law or these Terms.
Upon termination, your access to the platform will be revoked. Tickets you have already purchased remain valid for the corresponding events, subject to the event promoter's terms. Promoters whose accounts are terminated forfeit any non-refundable fees already paid.
12. Indemnification
You agree to indemnify, defend, and hold harmless EventPass Ticketing Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) as a promoter, any event you list, including event cancellations, attendee disputes, or inaccurate event information.
13. Waitlist Disclaimer
Joining a waitlist does not guarantee that tickets will become available. Waitlist notifications are sent on a first-come, first-served basis and each offer has a limited time window for purchase. If you do not complete your purchase within the offered window, the opportunity passes to the next person on the waitlist. EventPass is not liable for missed waitlist notifications due to device settings, network issues, or email delivery delays.
14. Force Majeure
EventPass shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, civil unrest, labor disputes, power outages, internet or telecommunications failures, or acts of God. In such cases, EventPass's obligations will be suspended for the duration of the event.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Jamaica, including the Data Protection Act, 2020. Any disputes arising out of or in connection with these Terms or your use of EventPass shall be subject to the exclusive jurisdiction of the courts of Jamaica, unless otherwise required by applicable consumer protection law.
16. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the platform constitutes acceptance of updated terms.
17. Data Protection and Privacy
EventPass is committed to protecting your personal data in accordance with the Data Protection Act, 2020 of Jamaica and other applicable data protection laws. We collect, use, store, and process personal data for purposes connected with the operation of the platform, including account management, ticket purchases, payments and refunds, event communications, fraud prevention, customer support, and legal compliance.
Event organizers using EventPass may receive limited personal data relating to ticket purchasers and attendees for legitimate event-management purposes such as ticket validation and event admission. Organizers must use such data only for lawful event-related purposes and must not sell or misuse attendee data.
Payments are processed by third-party payment processors. EventPass does not store full payment card details unless expressly stated and lawfully permitted.
Data subjects may have rights including access, correction, objection to processing, deletion, and withdrawal of consent. Requests may be submitted to support@eventpassja.com.
